These Terms and Conditions (the “Terms”) govern every rental of a vehicle from Dubai Rental Cars (“the Company”, “we”, “us”) and every use of the website dubairentalcars.com and any related booking channel. By browsing the site, placing a booking, taking delivery of a vehicle, or signing the rental agreement at pickup, you (the “Customer” or “Renter”) confirm that you have read, understood, and accepted these Terms in full. These Terms should be read together with the Company’s Privacy Policy, which explains how we handle your personal information. In the event of any conflict between these Terms and the rental agreement in respect of a specific rental, the rental agreement prevails to the extent of the conflict.
Article 1 — Definitions
In these Terms: “Company” means Dubai Rental Cars, the vehicle rental business operating through dubairentalcars.com and the Company’s Business Bay office, including its affiliates within the DriveX group; “Customer” means the individual who enters into the rental agreement and takes delivery of the Vehicle; “Vehicle” means the specific motor vehicle delivered, including all keys, registration card, and accessories; “Rental Period” means the period from delivery to return as recorded in the rental agreement; “Booking” means the Customer’s reservation, confirmed in writing by the Company; “Security Deposit” means the refundable amount held as security under Article 6; “CDW” means Collision Damage Waiver; “SCDW” means Super Collision Damage Waiver; “Salik” means the Dubai toll system; “RTA” means the Roads and Transport Authority of Dubai; “IDP” means International Driving Permit; “UAE” means the United Arab Emirates; and “Force Majeure” means an event beyond the reasonable control of the affected party, including natural disasters, war, civil unrest, epidemic measures, and wholesale infrastructure failure.
Article 2 — Eligibility and Driver Requirements
2.1 Minimum Age. The minimum age for the primary driver and any additional driver is twenty-one (21) years. For vehicles in the luxury and sports categories, the minimum age is twenty-five (25) years. A young-driver surcharge may apply for drivers aged 21–25 renting a luxury vehicle, at the rate set out in the Company’s fee schedule.
2.2 Driving Licence. Every driver must hold a valid UAE driving licence (for residents) or a valid foreign licence together with an IDP (for visitors whose licence is not on the RTA’s list of recognised countries). The licence must have been held for at least one (1) year immediately preceding the rental.
2.3 Additional Drivers. Any individual other than the primary driver who will drive the Vehicle must be registered as an additional driver at the time of delivery, must satisfy the criteria in this Article, and must be present at delivery to sign the rental agreement. A fee may apply per additional driver. Driving by an unregistered individual is a breach of these Terms and may invalidate the insurance cover.
2.4 Right to Refuse. The Company reserves the right to refuse to release a Vehicle where the driver does not satisfy the criteria above, where the documentation is incomplete or appears invalid, or where the driver appears unfit to drive. The Company’s decision in this regard is final.
Article 3 — Booking and Reservation
A Booking is a reservation for a Vehicle on a specified date and location, made through the website, WhatsApp, telephone, or in person. A Booking is not binding on the Company until the Customer has received a written confirmation quoting a Booking reference. Bookings are made by vehicle category (economy, SUV, luxury) rather than by specific make and model; the Company reserves the right to substitute a vehicle of equivalent or higher category where the booked vehicle is not available, at no additional charge. A Booking may be amended up to twenty-four (24) hours before the scheduled pickup time through the original booking channel; the Company will use reasonable endeavours to accommodate later amendments but cannot guarantee them.
Article 4 — Rental Period and Vehicle Return
The Vehicle must be returned to the location agreed in the rental agreement at the date and time specified. A grace period of one (1) hour applies; later returns attract an additional day’s rental at the daily rate. Where the Customer wishes to extend the Rental Period, the Company’s written agreement (which may be given by WhatsApp or email) must be obtained not less than twenty-four (24) hours before the original return time; the Company may refuse an extension where the Vehicle has been reserved for another customer. Early return does not attract a refund of the unused portion of the Rental Period, except where the Company, at its sole discretion, issues a credit note. The Vehicle must be returned in the same condition as delivered, fair wear and tear excepted; the interior must be clean and personal belongings removed.
Article 5 — Rental Rates, Fees, and Payment
The rental fee quoted at the time of Booking is inclusive of the daily (or weekly or monthly) rate, the standard CDW, unlimited mileage within the UAE, and full-to-full fuel provision. The fee is exclusive of the Security Deposit (Article 6), optional extras, Salik, traffic fines, parking fees, and any administrative or cleaning fees. All prices are quoted in UAE Dirhams (AED) and include VAT at the prevailing rate. Delivery and collection within the Company’s standard zone (central Dubai and the airports) is included; delivery outside the standard zone attracts a fee per the fee schedule. Optional extras (additional drivers, child seats, GPS, SCDW, Personal Accident Insurance, Tyre and Windscreen Cover) must be requested at Booking or at the latest at delivery. The Company accepts payment by Visa and Mastercard credit and debit cards, by cash (AED) at the office, and by bank transfer for corporate settlements. Cheques are not accepted.
Article 6 — Security Deposit
6.1 Deposit Amount. A Security Deposit starting from AED 1,000 and rising to AED 3,000 or higher (depending on vehicle category) is required at the time of delivery. The exact amount is communicated at Booking and recorded in the rental agreement.
6.2 Payment Methods. The Deposit may be blocked on the Customer’s credit card by way of pre-authorisation (the Company’s preferred method) or paid in cash (AED) at the office. Bank transfers from outside the UAE are accepted for corporate settlements only; all transfer fees are borne by the Customer.
6.3 Usage. The Deposit serves as security for damages not covered by insurance, unpaid traffic fines, Salik toll charges, late return fees, cleaning fees, and any other charges arising from the Customer’s use of the Vehicle. Unlimited mileage is included; no additional mileage charges apply.
6.4 Refund. The Deposit will be refunded within thirty (30) days of return of the Vehicle. The thirty-day period reflects the time required for the RTA and Dubai Police to update their violation databases after the rental. For credit-card pre-authorisations, the Company will release the pre-authorisation within this period; the Customer’s bank may take additional days to reflect the release. For cash deposits, the refund will be arranged by bank transfer or by collection from the office.
6.5 Forfeiture and Itemised Statement. The Deposit, or a portion of it, may be retained where the Vehicle is returned with damage, unpaid fines, unpaid Salik, late return, or excessive soiling. An itemised statement of any deductions will be issued within seven (7) days of return. Disputes must be raised in writing within ten (10) days of receipt of the statement; disputes raised after this period are deemed waived.
6.6 Smoking Penalty. Smoking (including electronic cigarettes) inside the Vehicle is strictly prohibited and incurs a penalty of AED 1,000 (Dubai Police) plus AED 500 (internal cleaning fee), both deducted from the Deposit.
6.7 Post-Refund Charges. Where a fine or Salik charge is received after the Deposit has been refunded, the Customer remains liable. The Company will issue an invoice for the amount plus an administration fee of AED 50 per violation, payable within thirty (30) days. Non-payment may affect the Customer’s ability to make future Bookings.
Article 7 — Insurance Coverage
Every rental includes Collision Damage Waiver (CDW), which limits the Customer’s liability for damage to the Vehicle to the deductible (excess) specified for the Vehicle’s category (typically AED 1,000 for economy vehicles, rising to AED 5,000 or more for luxury vehicles). Third-Party Liability cover as required by UAE law is also included. Optional upgrades — Super Collision Damage Waiver (SCDW), Personal Accident Insurance, and Tyre and Windscreen Cover — may be purchased at the time of Booking or delivery at the rates in the fee schedule.
The insurance cover (whether standard or upgraded) does not apply where damage arises from: driving under the influence of alcohol, drugs, or any impairing substance; use of the Vehicle for an illegal purpose; use by an unregistered driver; off-road use of a non-designated Vehicle; use on a racetrack or in any competitive event; damage to the interior, tyres, wheels, or windscreen (where the relevant optional cover has not been purchased); damage from an unreported incident (see Article 9); theft where the keys were left in the Vehicle; or any breach of these Terms.
Article 8 — Vehicle Use and Prohibited Activities
The Vehicle may be used for personal and private transport within the UAE only. The following uses are strictly prohibited: taking the Vehicle outside the UAE (a breach attracts a charge of AED 5,000 and may result in immediate termination of the rental); off-road use of any Vehicle not designated for off-road use; driving under the influence of alcohol, drugs, or any impairing substance; use of the Vehicle for any illegal purpose, including transport of controlled substances; use in any motorsport, racetrack, or competitive event; use as a taxi or ride-hailing service; commercial advertising, photography, or film production without prior written consent; smoking inside the Vehicle; transport of hazardous or flammable substances; transport of animals (other than registered assistance animals) without prior consent; sub-rental or transfer of possession to any third party; and any modification of the Vehicle (including vinyl wraps, decals, or aftermarket accessories). Where the Customer breaches any provision of this Article, the Company may terminate the rental with immediate effect, recover the Vehicle at the Customer’s expense, retain the Security Deposit in full, charge the Customer for any damage (without limitation by the deductible), and report the matter to the Dubai Police where the breach may constitute a criminal offence.
Article 9 — Mileage, Fuel, Salik, and Fines
9.1 Unlimited Mileage. Unlimited mileage within the UAE is included in the rental fee, subject to the cross-border restriction in Article 8. The Company does not, however, permit mileage accumulation in a manner that constitutes commercial abuse (e.g., extended intercity shuttle service); where such abuse is reasonably suspected, a per-kilometre charge may apply on mileage exceeding 500 km per day.
9.2 Fuel Policy. The Vehicle is delivered with a full tank of the correct fuel type (or, for electric vehicles, at a state of charge of at least eighty per cent) and must be returned in the same state. Where the Vehicle is returned with less than a full tank (or lower state of charge), a refuelling service fee of AED 50 plus the cost of the fuel (or electricity) will be charged. Use of the wrong fuel type must be reported immediately; the Customer is liable for the cost of draining, flushing, and any consequential engine damage.
9.3 Salik Toll. Every Vehicle is registered with Salik. Each Salik gate passage incurs a charge of AED 6, deducted from the Security Deposit. An itemised list of passages is provided with the deposit statement.
9.4 Traffic Fines and Parking. Traffic fines imposed during the rental period are the responsibility of the Customer. The Company will process fines on the Customer’s behalf; an administration fee of AED 50 per fine is added. Parking fees at public, private, and metered car parks are the responsibility of the Customer. Other-emirate tolls (such as Abu Dhabi Darb) are the responsibility of the Customer and are reconciled against the Deposit on the same basis as Salik.
Article 10 — Maintenance, Damage, and Incidents
The Company delivers every Vehicle in a roadworthy condition with a current registration and valid insurance. For rentals of more than seven (7) days, the Customer is responsible for routine checks of engine oil, coolant, washer fluid, and tyre pressure. Any defect, warning light, or unusual behaviour must be reported to the Company without delay; the Customer must not continue to drive the Vehicle where to do so would cause further damage or pose a safety risk. The Customer must not arrange any repair without the Company’s prior authorisation. A vehicle condition report is completed jointly at delivery and at return; damage not recorded at delivery but present at return is presumed to have occurred during the rental period and is charged to the Customer.
Where the Vehicle is involved in any incident — collision, damage, theft, attempted theft, vandalism, fire, or flood — the Customer must report the incident to the Company within two (2) hours and to the Dubai Police without delay, and must obtain a police report or accident report for the Company’s file. Failure to report is a material breach and may invalidate the insurance cover. The Customer’s liability for damage is limited to the deductible under the standard CDW, or to zero where SCDW has been purchased; where the damage arises from a cause excluded under Article 7, the Customer is liable for the full cost of repair. Where the Vehicle is stolen, the Customer must hand over the keys on request; where the Customer has complied with all obligations, liability is limited to the deductible, but where the keys were left in the Vehicle or the Vehicle was left unlocked and unattended in a public place, the Customer is liable for the full replacement value. Loss of keys attracts a replacement cost of AED 1,500 to AED 5,000 depending on the Vehicle, plus any towing costs.
Article 11 — Cancellation and Refund Policy
11.1 Free Cancellation. Cancellations made more than forty-eight (48) hours before the scheduled pickup time are free of charge. Any rental fee paid in advance will be refunded in full to the original payment method within seven (7) to fourteen (14) business days.
11.2 Late Cancellation. Cancellations made between forty-eight (48) and twenty-four (24) hours before pickup attract a charge of fifty per cent (50%) of the rental fee.
11.3 Last-Minute and No-Show. Cancellations within twenty-four (24) hours of pickup, and failures to collect the Vehicle at the scheduled time (no-shows), attract a charge of one hundred per cent (100%) of the rental fee.
11.4 Force Majeure. Where the Customer is prevented from proceeding with a Booking by a Force Majeure event (e.g., death of an immediate family member, medical emergency with certificate, or UAE government travel restriction), the Company will, on receipt of reasonable supporting evidence, waive the cancellation charge or issue a credit note for a future rental, at the Company’s option.
11.5 Cancellation by the Company. The Company reserves the right to cancel a Booking where the Vehicle is not available for any reason. Where the Company cancels, any rental fee paid in advance will be refunded in full, and the Company will use reasonable endeavours to offer an alternative vehicle of equivalent or higher category at no additional charge.
Article 12 — Limitation of Liability and Termination
The Company provides the rental service with reasonable skill and care. The Company’s total liability to the Customer in respect of any rental is limited to the rental fee paid for that rental, except where the liability arises from the Company’s gross negligence, wilful misconduct, or breach of UAE data protection law. The Company is not liable for any indirect, incidental, or consequential loss (including missed flights, missed hotel reservations, or business loss) even where the Company has been advised of the possibility of such loss. Twenty-four (24) hour breakdown assistance is provided; where the Vehicle breaks down through a cause not attributable to the Customer, the Company will, at its option, repair the Vehicle, provide a replacement of equivalent category, or terminate the rental with a pro-rata refund. The Customer indemnifies the Company against any claim brought by a third party in respect of the Customer’s use of the Vehicle, except to the extent that the claim arises from the Company’s gross negligence or wilful misconduct.
The Company may terminate the rental with immediate effect where the Customer commits a material breach (including but not limited to driving under the influence, use of an unregistered driver, taking the Vehicle outside the UAE, off-road use where prohibited, smoking, damage through misuse, non-payment, or provision of false information). On termination by the Company, the Customer must return the Vehicle within twenty-four (24) hours at the Customer’s expense, and the Deposit will be retained pending reconciliation. The Customer may terminate the rental early by returning the Vehicle in accordance with Article 4; no refund is payable for the unused portion except where the Company, at its sole discretion, issues a credit note.
Article 13 — Governing Law and Dispute Resolution
These Terms and any rental agreement entered into pursuant to them are governed by the laws of the United Arab Emirates, including the laws of the Emirate of Dubai and the regulations of the RTA. Where a dispute arises, the parties shall first attempt amicable resolution by direct discussion within thirty (30) days. Where the dispute is not resolved within that period, either party may escalate to the Dubai Courts or, where both parties agree in writing, to the Dubai International Arbitration Centre (DIAC) under the DIAC Arbitration Rules in force at the time. The seat of any arbitration shall be Dubai, and the language shall be English (with Arabic translation where required by UAE law). Nothing in this Article deprives the Customer of any rights granted to consumers under UAE Federal Law No. 15 of 2020 on Consumer Protection.
Article 14 — Changes to These Terms
The Company may update these Terms from time to time. The “last updated” date above indicates when the current version took effect. Material changes will be notified to customers with an active Booking or rental by email not less than fourteen (14) days before the change takes effect, and a notice will be displayed on the Site. The version of these Terms that applies to a particular rental is the version published on the Site at the time the rental agreement is signed. Continued use of the Company’s services after the effective date of a non-material change constitutes acceptance of the updated Terms.
